Former St. Anne-Nackawic employees lose lawsuit against the CAW

Eight former employees of the St. Anne-Nackawic pulp and paper mill in New Brunswick have lost their lawsuit against their union, the Canadian Autoworkers Union (CAW) as well as the former union boss Buzz Hargrove.

The workers claimed that the CAW lied to them back in January of 2006 when a new agreement was put in place with AV Nackawic Inc. and Tembec, who bought the idled mill.

The workers claim the union made them understand that the agreement included hiring the employees back in order of seniority.

However, the eight workers were not re-hired.

Court of Queen's Bench Justice Judy Clendenning ruled today that the workers failed to prove that the union acted in bad faith towards its members. She accepted the testimony from the union that they fairly represented the workers and that the agreement was the best deal that they could get.
